Nintendo Sues for Early Switch 2 'Mockup' Reveal

Nintendo has initiated legal action against accessory manufacturer Genki, accusing them of trademark infringement following the release of renders depicting a "Nintendo Switch 2" mockup. This incident occurred months before Nintendo officially unveiled images of its new console.

Recall that just a couple of months ago, at CES 2025, Genki found itself at the center of controversy over the Switch 2 mockup. At that time, Genki claimed they had not signed a non-disclosure agreement (NDA) with Nintendo, asserting they had "nothing to worry about."

Genki showcased the Switch 2 mockup, which debuted three months before Nintendo's official unveiling, claiming it was based on an actual Switch 2 system they had access to, which they used to develop their accessories.

According to court documents reviewed by IGN, Nintendo alleges that Genki embarked on a "strategic campaign intended to capitalize on the public interest surrounding Nintendo's next-generation console." The lawsuit accuses Genki of trademark infringement, unfair competition, and false advertising.

Nintendo further stated that Genki boasted about having early access to the unreleased console and allowed guests to interact with the mockups. They argued that Genki's claims of compatibility with the Nintendo Switch 2 were misleading, as such guarantees would require unauthorized, illegal early access to the console.

The court papers detailed that in January 2025, Genki advertised having unauthorized access to the upcoming Nintendo Switch 2 console, which had not yet been publicly revealed by Nintendo. Despite later contradicting their initial claims of possessing a genuine console, Genki continued to assure consumers that their accessories would be compatible with the Nintendo Switch 2 upon its release.

View 3 ImagesNintendo also accused Genki of infringing on its trademarks through its advertising and competing directly with Nintendo and its licensed accessory manufacturers.

Additionally, Nintendo took issue with a tweet from Genki on January 20, where CEO Edward Tsai was depicted with a finger to his lips, captioned "Genki ninjas infiltrate Nintendo Kyoto HQ," and a pop-up on the Genki website that read: "Can you keep a secret? We can’t..."

Nintendo is seeking to prevent Genki from using the trademarked "Nintendo Switch" name in its marketing, to destroy any products or marketing materials referencing Nintendo's branding, and to recover unspecified damages, which they want to be tripled.

Over the weekend, Genki responded on social media, acknowledging the lawsuit and stating they are working with legal counsel to respond thoughtfully. They emphasized their independence and commitment to creating innovative gaming accessories, expressing pride in their work and confidence in the quality and originality of their products. While unable to comment in detail, Genki confirmed they are preparing to fulfill orders and showcase new products at PAX East.

Genki concluded their statement by thanking their supporters and reaffirming their focus on building gear for gamers, promising to share more information as soon as possible.

The Nintendo Switch 2 is scheduled to debut on June 5, with pre-orders having started on April 24 at a fixed price of $449.99. Due to high demand, Nintendo has warned U.S. customers that release date delivery is not guaranteed for those who pre-ordered through the My Nintendo Store.
